ABSTRACT REALITY STUDIOS TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern the engagement of Abstract Reality Studios ("Studio", "we", "us" or "our") for creative, production, audio, post-production, design and related professional services. By approving a quotation, estimate, proposal, statement of work, or making an advance payment to the Studio, the client ("Client") agrees to these Terms.

 

1. Scope of Services

Abstract Reality Studios provides creative and production services including, but not limited to, audio production, music production, recording, mixing and mastering, sound design and Foley, film and video production, pre-production, post-production, editing, colour grading, visual effects, motion graphics, branding, graphic design, conceptualisation and other related creative services. The exact scope, deliverables, timelines and fees for each project will be specified in the relevant quotation, proposal or written communication agreed with the Client.

 

2. Quotations & Project Confirmation

All quotations are based on the information and scope provided by the Client at the time of enquiry. A project will be considered confirmed once the Client has approved the quotation or proposal and, where applicable, paid the required advance. Any work requested outside the originally agreed scope may be quoted and charged separately. Unless otherwise stated, quotations are valid for 30 days from the date of issue.

3. Payments

The payment schedule for each project will be specified in the applicable quotation or proposal. Where an advance payment is required, work will commence only after the advance has been received. Final files, masters, high-resolution deliverables or other completed assets may be withheld until all outstanding payments relating to the project have been received. Any third-party expenses - including talent, musicians, voice artists, locations, travel, equipment rentals, stock assets, licensing, specialised software or external vendors - may be charged separately unless expressly included in the quotation. 4. Project Timelines

Any estimated delivery date is based on the agreed scope and assumes timely receipt of materials, approvals and feedback from the Client. Delays in receiving feedback, approvals, content or other required materials may result in corresponding changes to the delivery schedule. Urgent or accelerated timelines may attract additional charges.

 

5. Client Responsibilities

The Client is responsible for providing all materials, information, references, approvals and instructions reasonably required for the Studio to complete the project. The Client confirms that it has the necessary rights, permissions and licences to provide any materials supplied to the Studio for use in the project. The Studio will not be responsible for copyright, trademark, privacy or other claims arising from materials supplied or specifically instructed for use by the Client.

6. Revisions

The number and scope of revisions included in a project will be specified in the relevant quotation or proposal. Revisions must remain within the originally approved creative direction and project scope. Substantial changes to the brief, concept, script, edit, design direction, arrangement or other previously approved elements may constitute additional work and may be charged separately. Additional revisions beyond those included in the agreed scope will be chargeable.

 

7. Approvals

The Client is responsible for reviewing all materials carefully before providing final approval. Once a stage of work has been approved, substantial changes to that stage may be treated as additional work. Once final deliverables have been approved and supplied, subsequent modifications may be charged separately.

 

8. Cancellations & Project Holds

If a project is cancelled after work has commenced, the Client will be responsible for payment for all work completed and costs incurred up to the date of cancellation. Advance payments may be non-refundable to the extent that they cover work already undertaken, time reserved, third-party commitments or costs incurred by the Studio. If a project is placed on hold by the Client for an extended period, timelines and availability may need to be rescheduled. 9. Intellectual Property & Usage Rights

Unless otherwise agreed in writing, ownership or usage rights in the final approved deliverables will transfer or be licensed to the Client only after full payment has been received. Rights relating to third-party materials - including stock footage, stock music, fonts, photographs, software, samples and other licensed assets - remain subject to the terms of their respective licences. Unused concepts, drafts, rejected designs, alternate versions, project files, working files, session files and production methods remain the property of Abstract Reality Studios unless their transfer has been expressly agreed in writing.

 

10. Source Files, Sessions & Project Files

Final deliverables refer to the finished files specified in the quotation or proposal. Editable source files, raw footage, multitrack recordings, DAW sessions, design working files, project files, stems, VFX project files or other underlying production materials are not automatically included unless specifically stated. Where requested, these materials may be supplied subject to availability, technical feasibility and any applicable additional fee.

 

11. Music, Audio & Sound Production

Where the Studio provides music production, recording, mixing, mastering, sound design, Foley or other audio services, the specific deliverables and formats will be agreed for each project. The Client is responsible for obtaining any necessary permissions relating to compositions, samples, performances or recordings supplied by the Client. Unless included within the agreed scope, services such as additional recording sessions, extensive editing, alternate mixes, stems, instrumental versions, additional masters or format-specific deliverables may be charged separately.

 

12. Film, Video & Production Services

Production quotations are based on the agreed shoot duration, locations, crew, equipment and production requirements. Additional shoot hours, shoot days, locations, equipment, crew, travel, talent requirements or changes to the production plan may result in additional charges. Weather, location restrictions, talent availability, government restrictions, equipment failures and other circumstances outside the reasonable control of the Studio may require production to be rescheduled. 13. Post-Production, VFX & Design

Post-production and design timelines are based on the originally agreed creative brief and supplied materials. Changes to picture lock, duration, resolution, aspect ratio, edit, script or other underlying materials after post-production work has begun may require additional work and may be charged separately. The Studio is not responsible for variations caused by third-party displays, playback systems, streaming platforms, compression, printing processes or other environments outside the Studio's control.

 

14. Archiving & Storage

The Studio may retain project files for a reasonable period following completion but does not guarantee permanent storage or archival of Client projects. Clients are responsible for maintaining their own backups of final delivered files. Retrieval or restoration of archived projects, where available, may attract an additional fee.

 

15. Portfolio & Promotional Use

Unless confidentiality has been agreed in writing, the Studio may display completed and publicly released work for portfolio, showreel, website, social media, award submission and self-promotional purposes. Confidential or unreleased material will not knowingly be publicly disclosed prior to its authorised release. Clients requiring complete confidentiality or an NDA should notify the Studio before commencement of the project.

 

16. Third-Party Services

Where a project requires third-party vendors, platforms, talent, locations, equipment, software or licensed materials, their respective terms and availability may also apply. The Studio will not be liable for failures, delays, policy changes or service interruptions caused by independent third parties outside its reasonable control.

 

17. Limitation of Liability

The Studio will use reasonable professional care in providing its services. To the maximum extent permitted by applicable law, Abstract Reality Studios will not be liable for indirect, incidental, consequential or commercial losses arising from the use of its services or deliverables. Where liability cannot legally be excluded, the Studio's aggregate liability in relation to a project shall not exceed the amount actually paid to the Studio for the specific services giving rise to the claim. 18. Force Majeure

The Studio will not be responsible for delays or inability to perform services caused by circumstances reasonably beyond its control, including natural disasters, extreme weather, government restrictions, strikes, civil disturbances, power or internet failures, venue closures, illness or other unforeseen events materially affecting production. Where possible, the Studio and Client will work together to reschedule or reasonably modify the affected services.

 

19. Confidentiality

Both parties should treat non-public information received in connection with a project as confidential where its confidential nature is reasonably apparent. Where required, a separate Non-Disclosure Agreement may be executed for projects involving commercially sensitive or unreleased material.

 

20. Creative Discretion

Creative services are inherently subjective. While the Studio will work in accordance with the agreed brief and references, exact replication of another artist's, brand's, production company's or creator's work cannot be guaranteed and may not be appropriate for intellectual property reasons.

 

21. Changes to These Terms

Abstract Reality Studios may update these Terms from time to time. The Terms applicable to a particular engagement will ordinarily be those in effect when that project is confirmed, unless otherwise agreed in writing.

 

22. Governing Law & Jurisdiction

These Terms and any engagement with Abstract Reality Studios shall be governed by the laws of India. Subject to any mandatory provisions of applicable law, disputes arising from these Terms or the Studio's services shall be subject to the jurisdiction of the competent courts in Delhi, India.

By commissioning services, approving a quotation or proposal, or making payment toward a project, the Client acknowledges that they have read, understood and agreed to these Terms & Conditions.
